On 15 May 2013 the Royal Court of Jersey discharged an injunction which had been obtained by Nautech on 10 April 2013 against CSS and others.
In doing so it found that
a. The injunction had been obtained without full and frank disclosure by Nautech;
b. The injunction had been used wrongly to deprive CSS of the tools of its trade and to stop CSS’s legitimate business by strangling it at birth;
However, the Court also confirmed that Nautech was entitled to copyright and protection of its confidential information.
The effect of this ruling is that CSS is free to compete with Nautech.
