Hello all,
It has come to our attention that many clients and contractors have been contacted regarding issues with Ryan Dunning, Stephen Coleman and Chris Inns’ former employers.
If you have received such you have unfortunately been misinformed. The Royal Court of Jersey has affirmed that CSS is fully entitled to compete with Nautech. Nautech has repeatedly failed in its attempts to use Court orders to stop CSS from trading. The most recent reasoned judgment is awaited, but the Court has already made clear its decision. We can provide a copy of the latest judgment when it is available. An earlier judgment is available at http//www.jerseylaw.je/Judgments/UnreportedJudgments/Documents/Display.aspx?url=2013%2F13-05-15_Nautech_Services_Ltd-v-CSS_Ltd_and_Others_089.htm.
We would draw your attention to the summary at paragraphs 92 to 96.
It is simply not true that CSS has admitted to unlawfully taking "the Nautech Database", nor that such a thing exists. There is no Court order prohibiting CSS from using such a thing. There is an injunction preventing CSS and others from infringing copyright in any information confidential to Nautech. CSS is abiding by this injunction and is trading freely, as the Court has said it must be allowed to do.
The litigation in Jersey therefore provides absolutely no reason for any person to decline to do business with CSS.
