I just received this email from Huxley Associates ( Agency ) regarding the new Agency Workers Regulations coming into force on the 1st of October 2011 .

If your a contractor , your working rights and conditions may be affected ?

Does any body know what this new crap is ? I hate to think what next .

    Cheers

"The Regulations will give agency workers the right to the same basic working and employment conditions they would receive if they were engaged directly by an end user client to do the same job; this is limited to conditions that relate to pay and working time.
Agency workers will also be entitled to access on-site facilities that an end user client provides to its own workers and to be advised by a client of vacancies which arise in the client’s business."

Also "The Regulations provide a right to "equal treatment" which does not apply until an agency worker has undertaken the same role, whether on one or more assignments, with the same hirer for 12 continuous weeks. "

So only applicable after 3 months or continuous work with that company. However this means that if it did apply then you would be entitled to the same sickness and holiday pay as a staff member.

Think its more aimed at big companies who take in agency staff on the cheap and keep them on at the low rates rather than take on full time employees.

A few companies such as Sonsub who use regular Agency personnel already give them the same terms (loyalty bonus etc.) as their own people.

Judging by the low rates offered to agency guys by Sonsub, bonuses are definitely the order of the day! 😉
